By accessing or using the TestBox services, you are agreeing to the terms and conditions listed here. If you are using the TestBox services as an employee, agent, contractor or affiliate of a corporation or similar entity, then you acknowledge that you have the authority to sign for and bind such entity in order to accept the terms of this agreement.
This Privacy Policy describes the ways TestBox Inc. (“TestBox”, “we”, “us”, and/or “our”) collects, uses, and discloses information about you through TestBox’s websites and services, including all associated features and functionalities, user interfaces, and applications (collectively, the “Services”). In this Privacy Policy, “you” refers to individuals who use TestBox’s Services. By using the Services, you consent to the processing of your information described in this Privacy Policy.
This Privacy Policy does not apply to any third-party applications or software that you may test or otherwise use in connection with our Services (“Third-Party Tools”).
TestBox collects information from individuals who visit TestBox’s web site(s) (“Visitors”) and individuals who register to use the Services (“Users”). When you reach out to us asking for more information about our Services, or when you register to use our Services, we require you to provide personal contact information (such as name, company name, address, phone number, and email address), and depending on the Third-Party Tool you are testing through TestBox, we may require you to provide credentials related to your account with that Third-Party Tool provider. Anything that you provide to TestBox that can be used (directly or indirectly) to identify an individual is referred to as “Personal Data.” We may also collect Personal Data from you if you choose to participate in a survey or live feedback call we conduct or if you contact us by email; through our branded social media accounts; through any integrated chat providers we may offer; or by telephone, SMS or physical mail. On these occasions we may collect your name, contact information, and any information you choose to provide as part of that survey or communication. In addition to the information provided by you, TestBox may also collect information from you while you are on the TestBox website and while you are using the Services, which may include analytics tracking, web beacons, cookies, embedded web links and other common information-gathering tools (“Data Tools”). These tools collect certain standard information that your browser sends to the Services such as your browser type and language, access times, and the address of the website from which you arrived at a TestBox website. They may also collect information about your Internet Protocol (IP) address, clickstream behavior (i.e., the pages you view, the links you click, and other actions you take in connection with the Services) and product information. TestBox may also use some of these Data Tools in emails sent from TestBox and therefore may collect information using these tools when you open the email or click on a link contained in the email. Finally, TestBox may from time-to-time work with third-party ancillary service providers in the course of its business (for example, third-party marketing support tools, etc. that collect non-personally identifiable information and/or Personal Data through TestBox’s website, emails, and third-party websites). Some of these third-party marketing support tools may follow your online activities over time by collecting usage data through the Data Tools. They use this information to provide ads about products and services tailored to your interests. You may see these ads on other websites. The process with these third-party marketing support tools helps us manage and track the effectiveness of our marketing efforts over time. TestBox uses Personal Data to perform the Services requested, including:
TestBox may share Personal Data with: (a) TestBox’s subsidiaries and affiliated companies; (b) subcontractors and other third-party service providers; (c) auditors or advisers of our business processes; and (d) potential purchasers or investors in the company.
In addition, TestBox shares limited Personal Data with Third-Party Tools with whom we have partnered. For instance, we share the name of your organization with Third-Party Tool providers when you sign up for TestBox. If you indicate that you are interested in purchasing a particular Third-Party Tool we share additional information about you with that Third-Party Tool provider, including your name and contact information so that the provider may reach out to you to facilitate your purchase. TestBox may share, sell, rent or trade aggregate data and disaggregate anonymized data, some of which may be based on Personal Data, and may use the same for purposes of promoting and improving its products and Services.
TestBox reserves the right to use or disclose Personal Data if it has a good faith belief that disclosure is necessary to: (a) comply with the law or with legal process served on or to cooperate with any legal investigation; (b) protect and defend TestBox’s rights or property of those of its users; (c) act in an emergency to protect someone’s safety; or (d) investigate any violation or potential violation of the law, this Privacy Policy, applicable Services license restrictions, any other agreements between you and TestBox or other activity that is illegal or may expose TestBox to legal liability.
TestBox may share Personal Data with any company that acquires its company or assets. That company will possess the Personal Data collected by TestBox and will assume the rights and obligations regarding Personal Data as described in this Privacy Policy.
TestBox may share Personal Data if you provide prior consent to do so.
TestBox may transfer and access Personal Data to and from around the world, including the United States where its domain is based or any country where we have operations of where we engage vendors or service providers. These countries may not have the same data protection laws as the country in which you originally provided the data. We rely on a variety of legal mechanisms to help lawfully support transfers of personal data outside the country where it was collected. To the extent permitted by law, by using our Services or submitting your Personal Data to us, you agree to such transfers.
Depending on where you are located, you may have the right to request a copy of the Personal Data TestBox holds about you and/or to correct any inaccuracies within such data, and TestBox is required by applicable laws to respond to such requests, then you may address such requests to the contact information provided in the “Contact Us” section below. TestBox will use reasonable efforts to supply, correct or delete information that we hold about you or to advise you if we are not required by applicable laws to comply with such requests.
Users may update or change their registration information by emailing us. Requests to access, change, or delete your information will be handled within 30 days or the maximum amount of time allowed by law, and should be sent to privacy@testbox.com.
You can opt out of receiving our promotional communications at any time by following the instructions within those communications. Please be aware that it may take up to 10 days for us to process your request and you may continue receiving promotional communications from us during that period. Users cannot opt out of receiving transactional communications (such as related to your account with TestBox or the Services).
Testbox does not currently change its behavior in response to web browser “do not track” signals. However, you can configure most browsers to reject cookies or to notify you when you are sent a cookie, giving you a chance to decide whether or not to accept it. You can consult the help section of your browser to learn how to do this. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services. In the event that a universally accepted standard emerges on how organizations should respond to “do not track” signals, we will re-assess how we respond to those signals.
Testbox uses generally accepted administrative, physical, and technical safeguards we believe are appropriate to protect the confidentiality, integrity, and availability of your Personal Data. Although we make reasonable efforts to protect your Personal Data from loss, misuse, or alteration by third parties, you should be aware that there is always some risk involved in transmitting information over the internet and storing information electronically. Testbox cannot and does not guarantee absolute security.
TestBox may change this Privacy Policy at any time by posting a new version on TestBox’s website. If we make material changes, we will provide additional notice, such as posting a statement on our homepage and notifying Users and their end users of any changes through the Services account(s), the email on file, or by other means. The new version will become effective on the date it is posted, which will be listed at the top of the page. Your continued use of the Services after the revised Privacy Policy has become effective indicates that you have read, understood, and agreed to the current version of this Privacy Policy, to the extent permitted by law.
The Services are intended for adults and TestBox does not knowingly collect Personal Data from children. If you become aware that an individual under the age of 13 (or a higher age threshold, where applicable) has provided us with Personal Data, please contact us immediately as described below.
